Parks Lombard calling for a moratorium. The park of Ticino is conspicuous by its absence

Richiesta di Moratoria sull’emendamento 13 bis alla L.R. 12/05 e sul PDL recante Norme per l'istituzione e la gestione delle aree protette e la tutela della biodiversità regionale

Gli scriventi sono Presidenti dei Parchi regionali della Lombardia, direttamente interessati dalle recenti e velocissime iniziative legislative regionali che, in parallelo, attraverso modifiche the Regional Planning Law 12/05, and through a plan to reform the LR 86/83, in terms of protected areas, aim to radically change the present structure of skills in the planning of protected areas.

Si tratta dunque di una previsione che altera profondamente il rapporto attualmente esistente tra istituzioni, mediante la sostanziale parificazione degli interessi di cui sono portatrici le amministrazioni comunali - e della loro pianificazione territoriale a fini urbanistici – con interessi di cui sono portatori gli enti parco, protagonisti di una pianificazione guidata da esclusive finalità di tutela dell’ecosistema.

noted that the regional statute, nearing completion, seems to have the necessary legal framework in which it could find placement reform regional legislation regarding protected areas, given the greater autonomy introduced by the reform of Title V of the Constitution, albeit in the context of concurrent jurisdiction, as occurs in the environment

propose a

moratorium for the approval of the amendment is to LR: 12/05 that del PDL sulle aree protette, che rinvii alla nuova amministrazione regionale, varato lo Statuto regionale, la modifica dell’attuale assetto di competenze tra Parchi e Comuni, in modo che la materia possa essere trattata senza strumentalizzazioni, con la serenità e la serietà che si conviene a scelte da cui dipende il futuro dei parchi lombardi e la tutela di un territorio, come si è detto, già pesantemente afflitto dal consumo dei suoli.
